Please note: This license agreement is effective for photos purchased
from 01/11/2006 to 16/10/2007.
This agreement governs the usage of photos purchased from
ropernet IT Ltd, via the mediastock.co.uk website. The agreement
is between you (the "Licensee") and ropernet IT Ltd, the provider
of photos on the mediastock.co.uk website. By purchasing any
photos from this website, you agree to be bound by the terms
of this agreement.
All photos available for purchase from this website, are
royalty-free photos.
1. LICENSEE'S RIGHTS:
- The Licensee may use the photo they purchased for
multiple purposes over an unlimited period of time.
- The Licensee is permitted to make one back-up copy of the
photo for archive or storage purposes.
2. RESTRICTIONS:
- The photo cannot be sublicensed or resold to any other party.
- The photo cannot be used in a defamatory, libelous or any
other illegal way, whether directly or indirectly.
- If the photo is used in any form where it can be easily copied (e.g. a
web page), it must be a maximum resolution of 600 x 400 pixels.
- If the photo has been purchased with the 'Web Resolution' or 'Print Resolution' option,
the use of the photo in resale items is forbidden. Resale items include,
but are not limited to: calendars, mugs, resale posters, t-shirts and templates. (If the photo
has been purchased with the 'Extended Rights' or 'Exclusive Rights' option,
the use of the photo in resale items is permitted).
- ropernet IT Ltd grants no rights and makes no warranties with
regard to use of names, trademarks, registered, unregistered
or copyrighted designs or works of art or architecture depicted
in any photos and the Licensee must satisfy itself that all
the necessary rights or consents regarding any of the above
have been obtained.
3. COPYRIGHT:
- The photographer remains the copyright holder of the photo.
4. EXCLUSIVE RIGHTS:
- If the photo has been purchased with the 'Exclusive Rights' option, once purchased
the photo will not be resold on this website, or by any other person as
agreed by the photographer for a period of 2 years from the date of purchase.
After this time the photo may be resold. Where the photo has not be purchased
with the 'Exclusive Rights' option, the photographer can sell it an unlimited
number of times to an unlimited number of people.
5. WARRANTY:
- ropernet IT Ltd guarantees the error free transmission
of the photo to the licensee. Should the photo be defective
due to download errors, the licensee shall be able to re-download
the photo.
6. IMDEMNITY:
- The Licensee agrees to indemnify and hold ropernet IT Ltd not
liable against any claims arising out of any breach of this
agreement.
7. DISCLAIMER OF WARRANTY AND LIABILITY:
- The photo is provided as is, under the guarantees provided
above. All risks related to the results or performance of
the image are assumed by the user.
8. TERMINATION OF CONTRACT:
- ropernet IT Ltd may terminate this contract immediately without
notice, if the Licensee violates any provision or representation
of this agreement.
- Upon termination the Licensee must immediately stop using
the digital media and delete or remove the digital media from
any computer system or electronic storage.
9. GOVERNING LAW:
This agreement shall be governed by and construed in
accordance with the Laws of England.
